1/ PRODUCT ITEMS

 

The essential characteristics of the products offered for sale are presented in the product description.

 

However, slight differences between the items presented online and the product delivered to the client may exist (cracks, marks of time, cracks …), due to the craft manufacturing of products Z’HOME and the type of wood used. Similarly, and taking into account the conditions of photographic shooting as well as the differences in the rendering of patinas by Internet browsers and / or monitors, the colours of the items delivered may present slight variations with those viewed online. These minor differences, as long as they relate to non-determining characteristics and do not affect the quality of the articles, shall in no way justify a cancellation of the order or a refusal of delivery.

 

2/ UNAVAILABILITY DUE TO COMPUTER UPDATES

 

The items offered for sale on the site are subject to availability.

In case of unavailability of the goods after the order, due to non-instantaneous stock updates, the customer will be informed as soon as possible and his order will be cancelled. The refund will be sent to the customer within 14 days of the cancellation of the order. If he/she so wishes, he/she may place another order for another product.

 

3/ PRODUCT PRICES

 

The prices are indicated in euros and include all taxes. Z’HOME reserves the right to modify them at any time, before the final validation of the order, particularly in the event of an increase in charges, the rate of VAT, and in the event of an obvious error. The products are charged at the rate in force on the site at the time of final validation of the order by the client.

 

Delivery costs are not included in the price indicated, unless otherwise stated.

 

4/ ORDERING

 

The choice and purchase of a Product is the sole responsibility of the Customer, particularly in terms of the relevance of the purchase to his/her needs. The Customer shall add the selected Products to his/her basket. The Customer has the possibility to check the details of his order, its total price and can make modifications before any final validation. It is therefore the Customer’s responsibility to check the accuracy of the order.

 

The client must fill out the information sheet on which he will indicate all the details requested and confirm the order and its payment, the seller will then communicate by email confirmation of the order recorded, this means that your order has been accepted and that a purchase contract has been made.

 

Z’HOME reserves the right to refuse an order for any legitimate reason, including the existence of an unresolved dispute resulting from non-payment of a previous order.

 

5 / CUSTOM ORDER

 

Some elements of furniture have the possibility of being ordered customized times of design and manufacture are indicated however Z’HOME is not responsible for delays in manufacturing by our partners

 

6/ PAYMENT

 

Payment is made by the means offered at the time of payment.

 

7/ DELIVERY

 

The type of transport, the time and costs involved will be specified at the time of ordering, depending on the place of delivery, the nature of the Products ordered and the nature of the service for which the Customer has opted.

 

The delivery of bulky items or furniture is carried out by a carrier specialised in furniture delivery. The date and time of delivery are agreed between the Customer and the carrier. Products delivered to the Customer’s home are delivered to the delivery address provided by the Customer at the time of ordering. Unless the Customer specifies a different delivery address, the delivery address for the Products shall be the postal address provided by the Customer on his/her Account. It is the Customer’s responsibility to check the delivery details when validating the order.

 

The seller cannot be held responsible in the event of an error in the delivery address provided. No claim and no refund will be made. The buyer will be asked to pay for the costs of re-shipment.

The buyer must collect the parcel from the relay point within 14 days, otherwise the parcel will be returned to the seller. The costs of returning the package will be charged to the buyer.

 

8/ RECEPTION AND COMPLAINT

 

At the time of delivery, the customer must ensure :

– the conformity of the goods received with those ordered

– that there are no apparent defects on the outside or inside of the packages

– that there is no damage caused by transport.

 

In the event of a complaint, the customer must

– Write the reservations on the delivery note or the transport note with the date and his signature, in a precise and motivated manner, the reservations of the type “subject to unpacking” are insufficient;

– Confirm to Z’HOME as well as to the delivery service concerned its reservations by registered letter with acknowledgement of receipt within a period of three 3 days from the date of delivery;

The client must be able to provide any justification as to the reality of the claims invoked and allow Z’HOME any facility to proceed to their observation, 3 photos, slip with reserve mentioned.

The claims accepted by Z’HOME will result in the exchange of the product concerned, or reimbursement in case of unavailability of the product in stock.

 

No spontaneous return, without the agreement of Z’HOME will be accepted. Z’HOME must be informed in advance of any request for return related to a complaint.

 

Please note that some wooden furniture products or leather sofas and armchairs may show traces of the material (cracks in the wood, slight difference in colour etc.)

 

9/ RIGHT OF WITHDRAWAL

 

In accordance with the terms of Articles L121-21 et seq. of the French Consumer Code, the customer has a period of fourteen (14) days from the date of receipt of the goods or their availability in the shop to withdraw. This right of withdrawal does not apply to goods made to the customer’s specifications or personalised (such as sofas with options) or which, due to their nature, cannot be sent back or are likely to deteriorate.

 

The costs (even when the delivery costs have been offered to the customer) and risks of returning the products are to be borne by the customer.

The products must be returned to Z’HOME in good condition and fit for resale, with its original parts (packaging, accessories, instructions, wiring, fasteners …), duly sealed, and accompanied by the invoice for the purchase. Any damaged, damaged or incomplete item will not be returned, refunded or exchanged.

 

10/ RESPONSIBILITY

 

Z’HOME is responsible for the proper execution of the contract of sale concluded through its site. However, Z’HOME could not be held responsible for any inconvenience or damage related to the use of the Internet (virus, interruption in service etc. ….).

The responsibility of Z’HOME under the products delivered, including in the context of contractual or legal guarantees applicable, is limited to the price of defective products or non-compliant. Z’HOME can not be held liable for compensation of indirect damages or any other financial loss suffered by the client or a third party.

 

11/ WARRANTIES

 

The client benefits from the legal guarantee of conformity as provided in Articles L211-1 to L 212-1 of the Consumer Code.

The customer also benefits from the legal guarantee against hidden or redhibitory defects as provided for in articles 1641 to 1648 of the Civil Code. In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

The guarantee cannot cover deterioration resulting from normal wear and tear or from a cause arising from the intrinsic qualities of the goods. The guarantee cannot cover deterioration resulting from abnormal use or use that does not comply with the seller’s instructions.

Damage caused by the customer or a third party (e.g. transport, handling, assembly etc. ….) is also excluded from the guarantee.

All requests concerning guarantees shall be made exclusively by e-mail.

 

12/ PROTECTION OF PERSONAL DATA

 

For the processing of orders placed via the Internet, Z’HOME collects a certain amount of personal data, in accordance with the provisions of the Data Protection Act of 6 January 1978, each user has a right of access, rectification, opposition and deletion of data concerning him.

 

13/ INTELLECTUAL PROPERTY

 

The content of the site is protected by the provisions of the intellectual property code. All models, photographs, logos, texts and trademarks appearing on this site have been registered and are the exclusive property of Z’HOME. Any use in the form of reproduction, modification, distortion, transmission or distribution is prohibited and constitutes an infringement that may engage the civil and criminal liability of its author.

 

14/ APPLICABLE LAW

 

Any order placed on this site is subject to French law.

The present general terms and conditions of sale of Z’home will be executed and interpreted in accordance with French law.
